How Contract Enforcement Shapes Entrepreneurial Confidence

Business Setup

Business Setup
M&J Africa November 6, 2026

A manufacturer wins a supply contract that could justify buying new equipment. Before placing the order, the owner asks what happens if the customer disputes delivery and withholds payment. The answer can determine whether the business invests upfront, expands in stages or walks away.

A credible route to resolve disputes gives owners a better basis for deciding how much cash to commit. The practical questions are how the dispute will be handled, what evidence each party will need and whether a favourable decision can actually lead to recovery.

What Zimbabwe and South Africa show

Zimbabwe’s Judicial Service Commission reported that the High Court completed more matters than it received during the reporting year and carried fewer cases into the following year. The same report identifies the High Court’s Commercial Division as Zimbabwe’s first paperless court, using an electronic case management system. The caseload figures cover the High Court as a whole. They do not establish how long a commercial dispute takes or whether the winning party collects. Zimbabwe Judicial Service Commission annual report

In Johannesburg, the Gauteng High Court’s Commercial Court directive describes a different feature of specialist dispute handling. A judge assigned to manage an eligible matter can address procedural issues before the hearing and will preferably hear the matter. Zimbabwe’s example shows how electronic filing changes access to case records, while Johannesburg’s shows how assigned judicial oversight can help organise a dispute before trial. The sources describe different measures, so they cannot rank the courts by speed. Johannesburg Commercial Court practice directive

Turn enforcement risk into an investment decision

The manufacturer can agree what counts as acceptance, who signs delivery records and when objections must be raised. It can tie further production to agreed milestones and test whether the business could still pay suppliers and staff if a disputed invoice remained unpaid. If that scenario leaves the business short of cash, it can stage the equipment purchase or negotiate better payment protection before committing.

M&J Africa can help you assess how customer commitments, payment terms and dispute exposure affect your investment plans. Get in touch to discuss your business controls and enquire for a tailored quote.
